Why don't I just sue
them / why did I not sue / what good does this do /
etc?
For one thing, I didn't think about suing them
immediately. The idea of suing didn't even surface until people here
started posting it. Now, if you are an attorney (any of you) maybe
you can chime in here - I'm pretty sure posting your story to the
internet pretty much destroys any chance of successful litigation.
At the very least, it seriously degrades it.
Secondly, even
if I had thought about it without posting it here (I assume it would
eventually have come to mind) - the cost of engaging in a lawsuit is
very high. The two attorneys I am friends with charge between $300
and $400 per hour. This adds up quickly, and there are no guarantees
in the legal system.
So - where does that leave us? Well, not
very far from where we were last week. I hope that posting what
happened here benefits someone else, should one of you ever find
yourself in the same situation. If this happens to you, and you
decide to take it to court I wish you all the luck in the world. As
for where it leaves me - I got a good deal of some gifts for my
sister-in-law, I had an experience that will makes me more cautious
of retail business, and I came out of it changed. If something like
this ever does happen to me again I will follow the hundreds
of people's advice here and take the business to court. This time
was a learning experience, I won't be as kind next time.
I'm
sorry if I have disappointed or upset so many of you. I will
continue to fight this as best I can, but at this point my voice is
not heard (not to say it ever was). Perhaps this incident will
change things at Circuit City - it did make the rounds and I am sure
they realized how closely they dodged the bullet. Perhaps it won't,
and another shopper will go the distance and sue them for insane
dollar figures. I hope that you understand my position even if you
disagree with it.
Note: This entire event was sent to
each newspaper and television station in the Denver area. The choice
of what to publish is not mine. I did what I could to inform
others.
