looks like the CC store Director won this battle. He assaulted undefined and got away with it. I wonder if CC will promote him for being a good director and trying to help keep CCs bottom line up. Good job! store director! in my opinion undefined didn't do much of anything in response to the store director's actions. sure he made a few phone calls. But so what of it? he beeitched and moaned on the internet and then after when it came time to really get the issue taken care of....he backed down and did not sue or press charges. Filing a police report doesn't do much of any good, its just gonna be filed away in some archive at the police dept. I have to say i find undefined's response of doing nothing except beeitching and moaning some more on the net and asking other ppl to call and yell at CC is quite disappointing.

If no lawsuit, at least get it on the press to notify the ppl in the area about this store director. Notifying BBB is also good.

Why don't I just sue them / why did I not sue / what good does this do / etc?

For one thing, I didn't think about suing them immediately. The idea of suing didn't even surface until people here started posting it. Now, if you are an attorney (any of you) maybe you can chime in here - I'm pretty sure posting your story to the internet pretty much destroys any chance of successful litigation. At the very least, it seriously degrades it.

Secondly, even if I had thought about it without posting it here (I assume it would eventually have come to mind) - the cost of engaging in a lawsuit is very high. The two attorneys I am friends with charge between $300 and $400 per hour. This adds up quickly, and there are no guarantees in the legal system.

So - where does that leave us? Well, not very far from where we were last week. I hope that posting what happened here benefits someone else, should one of you ever find yourself in the same situation. If this happens to you, and you decide to take it to court I wish you all the luck in the world. As for where it leaves me - I got a good deal of some gifts for my sister-in-law, I had an experience that will makes me more cautious of retail business, and I came out of it changed. If something like this ever does happen to me again I will follow the hundreds of people's advice here and take the business to court. This time was a learning experience, I won't be as kind next time.

I'm sorry if I have disappointed or upset so many of you. I will continue to fight this as best I can, but at this point my voice is not heard (not to say it ever was). Perhaps this incident will change things at Circuit City - it did make the rounds and I am sure they realized how closely they dodged the bullet. Perhaps it won't, and another shopper will go the distance and sue them for insane dollar figures. I hope that you understand my position even if you disagree with it.


Note: This entire event was sent to each newspaper and television station in the Denver area. The choice of what to publish is not mine. I did what I could to inform others.

Bravo, thanks for enlightening the FW community!

As to the Monday morning quarterbacks here, it's easy to second guess every decision everyone makes after the fact. I just lump them in with the masses who scream 'CLASS ACTION LAWSUIT' everytime a price mistake isnt honored here. It's amusing -)

I think you did us a favor by proving to us once again that we CAN NOT be kind to the big cooperation. The only way that they will hear us is from our lawyer. So next time, if I run into something like this, I know what I will do immediately -- calling the police and finding a lawyer on the next day.

I just checked my credit card statement and one of my transactions for 12 games never went thru! Looks like I got 18 games for $5 each and 12 games for FREE!

Wow, just...wow. Hope this turns into a PR nightmare for CC. As a woman, it definitely concerns me to know that CC managers can assault their customers with impunity. Think I'll share that concern with their CEO.

Kudos to you, though, OP for being such a standup guy & for your efforts to keep us posted.

You don't have to sue.

What he did was assault, and if you have witnesses, then it can be proved. Have the guy arrested - end of story.

So?

You won't take action why should we care anymore? At least in a soap opera you're guaranteed something will change once in a while.

Anyone want to start a pool? Undefined will have to agree if there is any monetary settlement it will then be distributed according to the ratio. For example, if the pool has $10,000, and if you have contributed $100 and the final settlement is $100, you will get a dollar back.

If no one wants to participate, then no one has any right to tell Undefined what he should do.

Another idea: anyone wishing to choose the OP's fate should be willing to pony up for the retainer of a top notch lawyer. There are at least a couple of reg's on FW who would be glad to at least offer an opinion. Whoever is willing to guarantee at least 10K on the initial retainer plus fees would be entitled to 50% of the final settlement, assuming there is one.

Btw: Merry Christmas! I never really bought into the whole 'XMAS' thing.

He did what he thought is right... Although I may not agree with his action, I do appreciate his post and admire him for doing what he believes.

Now… What did you do? If you don't care, why don't you just move on in your life? Why bother to post? What an a**…

Although I don't agree with undefined's decision, I do admire his restraint. Sometimes in this country we do get crazy with litigation, although litigation was probably needed in this situation.
