I agree that undefined is handling the whole situation in a restrained, thoughtful way. I hope he can later tell us that he reached a good resolution.

On the lawsuit issue - Certainly, out of hundreds of thousands of civil cases filed across the country, there are a few cases that seem out of line (though you have to remember that, like the McDonald's lawsuit, it's easy to get the wrong idea from a brief description of a case.) But warping the whole system on the basis of a few bad cases is equivalent to acting as if every pregnancy is going to produce quintuplets.

There is no way to change the system to shut out bad lawsuits without seriously hurting legitimate claims as well. And Victora's point about insurance companies is dead on. The single most accurate predictor of liability-insurance rates is the stock market. The next most significant factor is the amount of regulation an individual state places on liability insurers in that state.

For your pocket book it is . And regardless for the "good of all man kind" a monitary judgement is just as good as a policy change. Business don't like to give out cash and with themselves adopt actions and measures to prvent this in the future. But undefined to each his own and if your happy with the results that is really what matters. I just wish I had a CC in my town so I could have picked up a wholelotta games.

Nothing. I did not hear back from them today. I filed a formal complaint (criminal) against the Store Director this evening with Lakewood, CO police department. I will be sending the information about what has happened to local media outlets (tv,print,radio). I tried to give Circuit City the opportunity to handle the situation in a timely manner. I did not ask for money, only for an apology and certain internal actions (reprimand the managers, do not punish the young associate, implement better policy).

I did warn you of the time it actually takes for cc to do the right thing, so while I understand you wanting quick resolution, from a company's perspective, it just isn't possible. I wholeheartedly agree that you deserve an apology from the managers involved, that goes without saying (but I am saying it anyway--lol).

The internal processes that go into investigating matters like these are slow to be sure and it being right before xmas doesn't make it go any faster. Firing someone, especially a manager, is a long process for any major company looking to avoid wrongful termination suits. Also, if wither of the managers are over 5 year employees then they can only be terminated by a member of the "executive committee", that adds more time to the process.

I can tell you of one other case that I personally know of a manager who got into a physical confrontation with a customer and he most certainly was fired. This happened shortly before black friday and certainly hurt the store, but it was still done, so don't think that the time of year will stop cc from doing the right thing.

Just another ex-insider sharing some procedural knowledge

I'm impressed......there are still some decent people left that are not out for just for MONEY.....

I call BS.

It IS possible for a large corporation to make the correct response quickly. Unfortunately they choose not to make it the normal course of business.

Undefined, I don't think I could have been nearly as restrained as you've been and applaud your patience. Even more, I admire your efforts and determination to follow through on this matter. Most of us would have had good intentions but wouldn't put out the effort. It's likely that CC is expecting the same of you.

Thanks for the support. Being an idealist is worthless if one is unwilling to stand up for what they believe. I truly believe that action speaks louder than words or dollars. Any business can throw money at someone who is wronged, few will step up to the plate and take genuine efforts to prevent it from happening again.

I know you were trying to handle this in a way that you felt was correct, but all I have to say about filing the police report:

It is about time!!!

This should be assigned to an investigator (you may have to wait a day or two to find out who that will be). That person should contact you to talk to you about the incident. (If it is not assigned, then the PD is considering it done)

The investigator should then go to Circuit City, talk to those involved, look for/interview any non-biased witnesses and ask for any video from that time frame on that day. After the investigator has the statements, any video evidence and completed their report, it will go to the County Attorney for any possible charges.

(at least this is how it would work in my state)

At a minimum, any HQ person at CC has to realize (once they get a copy of the PD report -- and you know they or their legal department will) that this is not just an upset customer, but someone who was seriously wronged by one of their employees. If you "made it up", filing a false Police report would bring charges upon yourself.

Good luck and stay strong... You may have to follow up with the PD to make sure they act on this.

Please give us links to any news stories, TV or print, on this if/when they show up.
